1. Acceptance of Terms
By accessing or using the CampaignSwift platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.
These Terms apply to all visitors, users, and others who access or use the Service. By using the Service, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms.
If you are using the Service on behalf of a company or organization, you represent and warrant that you have the authority to bind that entity to these Terms.

CampaignSwift is an agency operations platform that provides tools for social media management, campaign orchestration, client management, team collaboration, and related services for digital marketing agencies.
The Service includes, but is not limited to:

- Unified inbox for social media messages
- Campaign planning and management tools
- Client portal and approval workflows
- Team collaboration features
- Analytics and reporting
- AI-powered content assistance
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice.
3. Account Registration
To use certain features of the Service, you must register for an account. When you register, you agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Maintain the security of your password and account
- Accept responsibility for all activities that occur under your account
- Immediately notify us of any unauthorized use of your account

4. Subscription & Billing
4.1 Subscription Plans
CampaignSwift offers various subscription plans with different features and pricing. Details of current plans are available on our pricing page.
4.2 Billing
Subscription fees are billed in advance on a monthly or annual basis, depending on your selected plan. All fees are non-refundable except as expressly stated in these Terms or required by law.
4.3 Free Trials
We may offer free trial periods. At the end of a trial, your account will automatically convert to a paid subscription unless you cancel before the trial ends.
4.4 Price Changes
We reserve the right to change our prices. Any price changes will be communicated at least 30 days in advance and will take effect at the start of your next billing cycle.
4.5 Refunds
We offer a 30-day money-back guarantee for new subscribers. If you are not satisfied with the Service within the first 30 days, contact us for a full refund.
5. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Infringe on intellectual property rights of others
- Send spam, unsolicited messages, or bulk communications
- Distribute malware, viruses, or harmful code
- Attempt to gain unauthorized access to systems or data
- Interfere with the operation of the Service
- Harass, abuse, or harm others
- Post content that is defamatory, obscene, or offensive
- Impersonate any person or entity
- Use automated systems to access the Service without permission
- Resell or redistribute the Service without authorization

8. Termination

8.2 Termination by Us
We may suspend or terminate your access to the Service immediately, without prior notice, if you:

- Fail to pay applicable fees
8.3 Effect of Termination
Upon termination, your right to use the Service will immediately cease. We will retain your data for a reasonable period to allow you to export it, after which it may be deleted.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Service will be uninterrupted, secure, or error-free
- The results obtained from the Service will be accurate or reliable
- Any errors in the Service will be corrected
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAMPAIGNSWIFT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
Our total liability for all claims related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
11. Indemnification
You agree to indemnify, defend, and hold harmless CampaignSwift and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or related to:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Your Content
12. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through the Service at least 30 days before they take effect.
Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which CampaignSwift is incorporated, without regard to its conflict of law provisions.
Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except where prohibited by law. You waive any right to participate in class actions.
